August 9, 2011 ­– Caliper Life Sciences Inc. announced it favorably settled two patent lawsuits with Carestream Health Inc.

Carestream filed one of the lawsuits in July 2010, alleging infringement of a patent covering multimodal in vivo imaging. The suit, filed in the U.S. District Court for the Western District of Wisconsin, Madison Division, Carestream alleged Caliper’s IVIS Lumina XR system infringes on Carestream Health’s U.S. patent relating to an imaging system where one or more immobilized small animals can be imaged in several imaging modes without moving the animal.

In the second lawsuit, filed in February 2010, Caliper, its wholly owned subsidiary, Xenogen, and Stanford University alleged that Carestream's marketing and sales of its instrument systems induced infringement of seven imaging patents that are exclusively licensed to Xenogen by Stanford University.

To settle these lawsuits, Carestream and Caliper have agreed to dismiss their respective claims and counterclaims. Carestream will not market and sell in-vivo optical imaging systems for certain applications covered by patents licensed from Stanford by Xenogen and Caliper. Carestream also agreed not to assert that the Lumina XR system as currently configured and sold by Caliper infringes any of Carestream's patents.
